Do you think an 18yo that dates a 16yo should be charged with statutory rape for consensual sex if the parents decide to press charges? With no repercussions for the 16 yo? What if the 16yo lied about their age? I saw a story a while ago about a 19yo (I believe) that was dating a 16 yo and her parents found out she gave him a BJ and decided to press charges. Now this kid has been in jail for a couple of months and will be branded this way after he gets out all for a BJ from a girl three years younger than him who was old enough to know what she was doing. So what do you think?

Many states have a certain age gap in which they will not press charges, but I believe (in CA anyway) it's 2 years i think that 4 years sounds more reasonable especially if they had a lagit relationship before the older person turned 19. However, once you get into higher ages it becomes more of an issue. Yes he/she was a willing participant, but maybe they weren't physically forced but there was cohersion, maybe they didn't know how to say no...blah blah blah.....so, 16yo with a 19yo, no I wouldn't say she's a victim, 16yo with a 30+ year old yes a victim, maybe she knew what she was doing but there may have been cohersion or threats0

5 year difference plus 16 or under where I live. Both conditions must exist to be considered rape.

I'd say a 2 year difference is plenty. A 19yo has no business being sexually involved with a 16yo. I could see where 3 years isn't too horrible but 5 is not right. 5 years means an 18yo can have sex with a 13yo and it's not a crime.0

I don't think it's fair to the guy to have to go to jail and always be known as a sexual predator for the rest of his life in that situation where there's a three year difference. Seriously. I can agree a 19 year old really shouldn't be getting sexually involved with a 16 year old but it's not that big of a deal. That's one year more difference than my boyfriend and I. When he was 19, I was 17. It wasn't a big deal. A 19 year old can be in a committed, serious relationship with a 16 year old. What if they started dating when they were younger...all of a sudden he hits 19 and they can't do anything?
Any bigger than 3 years though I would say is wrong. As pointed out a 15 year old shouldn't be sleeping with a 20 year old or whatever. But when there's such a small age gape it is possible the couple was together BEFORE the guy hit that age to make it illegal.0 -
what is the age of consent then? 18? it's 16 here and i think up to 20 isn't worth interference unless there's evidence of sinister behaviour. 21+ or 18+ and someone under 16 then yeah i think it should be actively discouraged. not sure jail is necessarily the answer but young girls dont always make the best choices for themselves and grown men should be frowned on for chasing after young girls.0

IMO, the lifetime sexual predator list regarding consentual relationships should be only for cases with a 10+ year age difference or 7+ years if 1 party is under 15. A 15yo and a 23yo is wrong but I've seen a lot of 15yo girls who look and act much older (by act, I don't mean mature, I mean sexually promiscuous partier types way beyond what any 15yo should be.)0

My ex-husband is 6yrs older than me. We started dating when I was 17 and I lied about how old he was. By the time my mother found out I'd lied, he an I were married and there really wasnt anything she could do ~ an no I wasnt prego when we married.
Having said that, I have 3 teenage girls and I have met every single boy they've been out with. I ask how old they are, and all kinds of questions. They were forbidden from dating someone more than 2yrs older than them until they turn 18. After that its a bit harder to enforce that lil rule.0 -

Yep. He's an adult. She is not. He has the responsibilty and legal responsibility that she does not have until she reaches legal age.
Laws vary from state to state. The laws are specific. You have to draw a line legally and enforce it or change it. Once this one becomes acceptable, then what about 15? Then, what about 14?
In soccer, once the ball completely crosses the line, it's out of play. It's not up for interpretation. The 19 yr old is lucky Dad called the cops and didn't approach him directly.
I know someone is going to make the argument that the girl was culpable. She was. But, the law doesn't read that way.0 -
Sadly, teenage girls are an easy lot for miscreants to take advantage of. They need to be protected. That's why the laws exist, because of that reality.0

Where is the law that would have kept me safe? Should I have to be punished because I was dating someone and we were both underage, but break up with him because we had NO choice but to get older?
There needs to be some sort of checks and balances so that CRAZY parents can't ruin someones life. I COULD have been classified as a sexual offender for the rest of my life because I had sex with my boyfriend (for about a year at this point) and I couldn't stop time.0 -

I dont think its ideal, but people need to worry about the 40 year olds grooming youngsters and not people of similar ages getting it on0 -

This! As a teenage girl I have to take responsibility for my actions. I was very sexually active from 14 onwards and damn if I wanted someone I was pretty damn determined to get my little underage claws into them. I have dated guys the same age as me, a year older, two years older...biggest age gap was ten years when I was 15, but tbf I lied and said I was 17 (age of consent here is 16) People definately portray teenage girls as a lot more naiive than they are,especially in popular culture, film/tv etc, it's always the guy trying to talk his gf into sleeping with him and older guys are always trouble, just looking for some hot underage *kitten*. Does it never occur to people that a hormonal teenage girl is a pretty powerful force to be reckoned with? And that a lot of girls WANT and ENJOY sleeping with older guys? Maybe the older guy should "know better", but when there's only a small age gap and you have chemistry and you care about each other, you don't feel like you're breaking the law, it just feels natural. AND some of the most caring, respectful and lovely bfs I've had have been a good few years older than me. Especially if the younger party looks/acts older than their years.
I think it should be assessed on a case to case basis, there is a difference between a 15 year old and 17 year old having consenting sex or a meaningful relationship, and a 17 year old trying to pressure a younger girl into sex when she doesn't want to. I don't think it should be the parents decision to prosecute, as a lot of parents would prosecute simply out of anger that little sally had lost her virginity. I know plenty of people who have dated someone just a year or two younger than them, but on the wrong side of the consent age, and then when they've broken up the younger partner has threatened the older with going to the police, just out of post break up bitterness, and it's not fair that someone can have their life ruined because of a messy teenage relationship.
And the older person definately shouldn't be punished if the younger one was lying about their age, a lot of kids, girls especially, look and act a lot older than their age, and you're not seriously gonna ID someone before you sleep with them are you?! It's not your fault if a younger person decieves you. In fact in that case, I think there should be repercussions for the partner that lied, therefore putting the older person in such a bad situation!
The age of consent laws are in place to protect young people from paedophiles, or older kids taking advantage of naiive little virgins. It shouldn't be used to punish people (and potentialls ruin their lives) who are in sexual relationships with people that know perfectly well what they want and what they're doing.0 -

While I agree with you in part, I still believe that the responsibility falls on the adult. There are many instances where a younger person is responsible and mature enough to have a relationship that includes sex.
And, if, at 15, you were having sex with a 25 yr old. He was dead wrong. I don't care how mature you believe you are.0 -

My friend sam started dating his gf when she was 14 and he was 17, and they've been together 3 years now, it's hardly an irresponsible or creepy relationship.0 -

We have the same arguments in the UK about under 16s as you have about the under 18s

Yeah, I think it's thought of as normal for kids in the UK to have sex well below the age of consent, and nobody bats an eyelid at age gaps here!
I also think kids here are a lot more grown up at a young age than kids in America seem to be, but no wonder if you're still treated like a child until you're 18!
Not saying whether it's a bad thing or a good thing, I just think here there is a lot more leeway concerning age gaps and underage sex, and it's more of a law no one really pays attention to rather than some kind of moral thing.
I really can't imagine living in a place where a 17 year old is considered a child, and you can actually be arrested for sleeping with someone that age...0 -

I think people should fight to change the laws. I think people under 21 should be able to date 16 and 17 year olds legally. But until the law is changed, those over 18 should stay away.0

I think the system in the UK is quite good, where the laws are in place, but they're not really enforced unless the so called victim really, really wants to prosecute.
Like, no one's going to arrest you just because someone decides to go to the police and say "yeah I know this 15 year old that's having sex with a 17 year old....go arrest them"0 -

I am certainly not aware of any similar cases to the one earlier described where a 19 year old was imprisoned for continuing to have sexual relations with his slightly-younger, but still legally a minor, girlfriend. From this side of the pond, that seems truly bizarre.0
