A woman finds a lotto ticket worth $1million and a judge has ordered her to pay it back to the woman who threw it away. The woman is claiming she cannot pay it back as she has gifted money to her children and bought a truck. Oh, the store clerk tried to get some money out of this too...
I think this is complete BS! Finder's keepers...espcially when it's garbage!

If she had lost it, and could prove she was the one who bought it, I think it should be given back to her. But............if she threw it away, tough *kitten*!0 -

If she had lost it, and could prove she was the one who bought it, I think it should be given back to her. But............if she threw it away, tough *kitten*!
The woman who got the winnings found the ticket in the garbage. What is unknown is HOW the other lady knew it was her ticket that got picked up from the trash.. and she apparently threw it away because the machine said it was "not a winner". I say tough **** to the "original" ticketholder.
I mean, If I threw something in the garbage because I thought it was worthless and someone picks it up knowing it has value, that would be MY problem.0 -
The whole story has so many missing pieces. The woman claims she threw the ticket away because the machine read it as a ticket that did not win. If that's true, the then cashier lied to her, or the machine is faulty.
Either way, she threw the ticket away. Someone else found it. Finders keepers. If she lost it, that's one thing. Throwing something in the garbage says "I no longer want this or claim ownership to it."0 -
Just to work for the devil pro bono for a minute...
"Finder's Keepers" is not any kind of law. In fact the actual laws generally say the exact opposite. If you find cold hard cash lying in the street it's your obligation to turn it into the authorities to see if anyone claims it.
I know how most of us "feel" and generally I agree with you. Just wanted to state that the courts don't take "finder's keepers" as any sort of defense.0 -
*IF* she discarded it because the machine told her it was a losing ticket, but it turned out to be the winning ticket, then she's entitled to the money. Since I don't buy these, does the machine tell you if you've won or lost right away?

I heard about this on the news this AM, from what I heard it was my understanding that she didn't intend to throw the ticket away, but was throwing away receipts (?)
I agree there are a lot of holes in how everything "went down".
I do find it odd that the other lady would regulary go through the trash of the store to try and find unclaimed lottery money. That just seems weird to me.
I find it funny that the store posted a sign that said "Do not take" after she found a winning ticket. LOL
As for the store, I know (in some states) the establishments will receive some sort of prize for selling the winning ticket, so were they going after the actual winnings of the ticket or the prize money they would have received for selling the ticket?
And, Macpatti - yes the machines should tell you right away if you won or not. Although on the rare occasion that I buy a lotto ticket, I never take it into the store to check for winnings. I check on-line, but I'm ultra-paranoid like that.0 -

I'm not sure, either...I know my mom plays the Florida lottery, and she plays very specific numbers on very specific cards in very specific orders...I guess someone like her would know right away if that was her ticket being played.
As for the machine thing...I know a lot of people who buy scratch-offs, don't even scratch them, but hand them back to the cashier to see if they've won. The machine will tell the cashier, not the customer. As in...it pops up on THEIR screen, not the customer. So they could in fact be lying about it. At least that's how it works here in my area. To me, not checking your scratch-offs (or even scratching them off, jeez!) or your lotto numbers...that's laziness and naivety IMO.
Edited to add: I do feel that, even though she obviously should have checked her ticket, she should be given something if they can prove the cashier lied or the machine was incorrect. I don't think the other woman should be made to give her money back, though.0 -

I guess I never noticed that type of activity before. I wonder if this will set a precedent for stores to NOT allow people to rummage through the trash now. lol0 -

I used to empty the trash can where everyone scratched their ticktes at a gas station I worked for,I got curious and checked a few 3 were winners.I think total it was $1500 -
Some people throw things away without really looking. Take those scratch off lotto tickets..there is a $20 ticket that had TWO prize chances, but the second one was in small print and people just didn't bother to read it....I worked at a convenience store and when I would toss the trash I would see these in the trash all the time...one fell out when I was taking the trash out and on a whim I picked it up and noticed the second chance was not scratched off...so I scratched it and the dang thing was a $100 winner..since then I had picked them up where ever I saw them (was a soda junkie and went to the store all the time for refills) and got in the habit of picking them up if I saw them....almost ALL of them had not been fully scratched..I won a ton of cash while these tickets were going around.
BUT I guess in this case it really depends...I wonder HOW she proved it was her ticket? Having the cashier say so is not really proof..especially when that much money is on the line..I wouldn't put it past the two to cook up some story and back each other up..people do it for a lot less....it would really depend on the facts....at least this other woman has money to hire a lawyer to fight for her heh. :happy:0 -
I think there are a lot of holes in the story - but if she threw it away in a public place, in a public garbage can, then it is no longer hers. how could she prove that it was hers to begin with unless she had her name on it or something? If she had thrown it away in her house and the lady picked it out of the garbage, that would be questionable. Not in a public place - sorry -0

I believe the gas station worker filed the first suit and I think I read that she claimed it was theirs as it was on their property. Honestly, she probably told the woman it WASN'T a winner and then was going to pick it out of garbage herself. When someone else got it out before her, she got pissed and filed the suit. This is the only thing that makes sense to me..

Besides, garbage on private property isn't there for people to go through I don't even think it's legal. If I intentionally threw away some travellers checks because the bank teller said they were signed wrong or somethin because the teller is trying to rip me off or made a mistake, that's still my money. The ticket is obsolete. The lady one the money the minute she bought the ticket. The ticket is merely an account number to her new bank account.0 -
