Thanks for your comments, I'm going to firstly put on head phones and not talk to him, if he catches me unawares and makes snide comments, I will tell him I'll report him and this is his last warning. If he still does it, I'll let HR deal with it.

Hmm, I can't because I travel with him that's when I interact with him. We don't work together in office, or I would probably have complained. Unfortunately we live in the same condo.
