    So, at no point do you think he should have realized he'd successfully gotten his daughter out of danger and was causing more injury than necessary?

    He did realize he caused more injury than necessary... when he stopped, called 911, realized they weren't going to make it in time and told the 911 operator that he was going to take the guy to the hospital himself... He didn't want to kill the man...

    I've been mulling this over for awhile now, hope you don't mind if I bring this thread back to life.

    I think the thing that bothers me the most is that this dad isn't going to trial. Isn't that the point of the American justice system? He's innocent until proven guilty, and from the general reaction to the situation, a jury of his peers would rule him innocent. I guess it worries me that this is sort of setting a precedent for crimes of passion - where do you draw the line that it's "excusable" to kill another human being? Will it extend from sexual abuse to the classic "husband comes home early from work"? The woman who finds out that her husband is cheating? People seeking revenge for their siblings, friends, etc? If people are so sure that this father "did the right thing", why would he not go to trial and be deemed innocent by a judge?

    I just feel that it opens a lot of doors that don't need to be opened.

    Trials are EXTREMELY expensive and it is within the prosecutor's right to decide that either there was not an actual crime committed or that it just simply is not a winnable case.

    Happens all the time.

    Nope and he should receive no jail time. Not even a fine. Not even anger management classes.

    My husband calls it Misdemeanor Murder... and it does happen all the time... especially here in Texas... though in this instance there is evidence that the dad killed the man.... The DA wasn't even willing to touch this case.
