Burst *resistant* is the term. But don't talk to is, talk to your lawyer about that back pain. You sure you didn't hurt your next too? Neck injury cases settle for me, just saying0

when you sign up for a gym membership you sign away liability to the owner so I don't think I would have a case0

Some are only able to take a certain weight before wearing down. Gym one would be getting WAY more use than your one at home.0

I understand that a gym one would get more use but it also should be one that is made of a higher quality such as a professional grade one and one that doesn't burst but rather slowlly lets the air out
edit: Should note that when I have seen them replace equipment I noticed that the tags on it show that they bought them at TJ Max which is not a professional place for equipment.....makes one wonder0 -
All balls are pretty much to the same standard. You sign a waiver, but the gym is still responsible for maintenance. As in, look, this stability ball is showing signs of wear and tear, perhaps we should take it out of rotation before someone gets hurt.
Oops, too late. I guess we should settle out of court for $3k0 -

Lawyers take cases for $3000? My wife got rear-ended and no one would touch her case because they felt she couldn't get more than 6k out of it no matter what. LoL.0 -
This is what is wrong with America. I fall down all the time hiking and cross-country skiing and I don't try to sue Mother Nature.0

I sort of being silly with my Let's Go Sue answer, but gym equipment failing while you are on it is completely different than tripping while walking, isn't it? I see people doing dumbbell presses on those things and if the ball burst while you were holding 50 lbs over your teeth its a serious issue.0 -
I deal with risk management & litigation all day everyday and I can tell you waivers rarely mean anything. As another poster said, a trip & fall is one thing, but faulty equipment is another. Whether you have a case or not could also depend on what state you live in.0

Less silly, but I would file something with their insurance company and even threaten a lawsuit. They need to have their feet held to the fire so that equipment is maintained properly the next time.0

Normally, I am completely against litigation for a number of reasons. That being said, I'll put this into another perspective: what if they allowed their power racks to become rickety, and someone had half a ton come crashing down on top of them after racking the weight? Faulty equipment where heavy weight is concerned is unacceptable.0 -
I did research into the other stability balls that they have in the gym and they are not even rated for gym usage and have a low weight limit. I don't think they are very concerned with their gym members if they were they would buy quality equipment not cheap or free stuff0
