OT: Job advice & my husband

My DH quit his previous job b/c they were not paying him for the hours he worked. Long story short, as a mechanic at a known chain he got paid booking hours.
That just means if he had to take apart a customers care to give a free quote on the problem & spent half the day diagnosing the issue he didn't get paid for all those hours unless the customers agreed to the repairs.
Well, working 60+ hrs a week & getting paid barely 40 or less wasn't cutting it for newlyweds.
We thought it was fabulous luck that he could get hired on immediately to work with his dad. Hourly pay & benefits.
Fast forward to now 3 weeks into this job & he still hasn't filled out any forms for tax purposes or anything.
They pay him cash. He asks everyday or so I'm told about these forms & is given the run around.
The front desk girl doesnt have them, has no idea on them & keeps directing my DH to the owner.
The owner is never in I'm told & when he is he's always busy in the middle of something & will get to him tomorrow.
I finally emailed the business Tuesday & never got a response. So I called this morning. Of course the owner was in but couldn't come to the phone b/c he was in the middle of something but could the girl who answered help me.
I explained I was so & so's wife & I was calling about the email I sent inquiring about when my husband was going to be able to fill out the forms to be put on payroll.
She gave me another email address. No offer to take my number or anything further.
I feel like my DH & now I are being given the run around.
In my email I asked the owner for a specific date on when he will fill out the forms since it's beyond 3 weeks at this point.
I also said if I didn't hear from him I would call directly. I mentioned with the new year approaching we usually file for taxes & need the paperwork. Also I didn't know the legality of not filling out the forms in a timely manner or how not being able to show proof of income would affect us in trying to buy a house in 2011.
My MIL said he tried the same kind of run around with my FIL when first hired too.
I suppose it might not look the best to have one's wife contact but my husband can be a pushover & I'm no nonsense.

Since your husband is working for his father, he can pay him cash and not have to report any taxes. This only works when you work for your family.0

my piece on this is, go with the flow and look for a new job. times are tough and something is better than nothing. but find a new job0

Yeah, finding a new job is what my gut says too.
The thing is he was a mechanic at a mom & pop shop for over 2 years but quit there late Spring this year b/c everyone got a pay cut to keep the business open. That was to keep from having to fire anyone in tough times which is a nice thought. For a couple who were paying for their own wedding, it really hurt us to take that pay cut.
So he left to go to this chain that promised more money & great benefits. He knew in advance it wasn't hourly & he knew what booking hours meant but they guaranteed him he'd be getting plenty of hours b/c that's just how it is at that chain.
So from beginning of summer to end of November that's where he was. Now this job isn't working out & I'm ready to lose it. We've had such a string of bad luck. He cant keep job hopping.
The lender we spoke to said the job hopping wouldn't affect us as long as it was in the same field. Well this new job with his dad isnt the same field. It's not even close.
I guess I'm just venting but it's hard when you keep getting the short end of the stick over & over. I know people have it worse & at least he has an income. I really am thankful for that. He didn't have a lapse in between jobs so that was great.

I think they are trying to get away with not paying taxes on him this year. They could be in so much trouble for not reporting he is working with them.
I would look up the laws in your state on the department of labors web site. You may find something helpful.
I know when employees threaten with the DOL here we get right to their request. No company wants to be audited by them. You could threaten that you are going to contact them, but that may put your husband is a difficult palce at work.0 -
What specific forms is your husband needing to fill out? His W2 information, etc?
If the employer is not providing the proper tax paperwork and is indeed giving you the run around, please contact your local IRS office and inform them of the situation and what is going on. They will be able to point you in the correct direction, or take legal action against the company to force them to supply those documents.0 -
The specific forms are any normal paperwork you'd fill out at a new job. This guy didn't ask for as much as a copy of his license. All he knows is his name & it's his other employees son. That's it. No SS# on record, nothing.
I looked up the Dept. of labor my my state of IL. Looks like they can legally pay you cash & leave it up to you to put aside for taxes.
However they're supposed to have proper documentation of every employee which they didn't bother to do.
Apparently, they have to offer insurance if you're full time which it seems this guy doesn't want to be hassled with over 1 employee.
I had that happen to me once. I left a job that was far to work closer in promises of going full time after a couple months. Well, I found out they never had intention of hiring me b/c they were a small business & didn't want to go through the hassle of insurance over one person. So I quit b/c they lied to me & were trying to string me along.
I will see if his boss replied to me or calls but I doubt it. Monday I will start calling everyday to speak to him & then I will start stopping by on my way home from work. He will either figure out he better properly document him or let him him go.
Either way, DH & I will have a chat tonight about him having to look elsewhere b/c this guy is a d-bag0
