To the OP: I would do all you can to avoid filing. Talk to all your creditors and try to work out a payment plan - most will work with you.

I don't know how it works in the USA but in Canada you get hooped for 7 years...you can claim it, but for 7 years you'll never get a loan, no vehicle unless you want to pay 30% interest, nothing! It's a big fat zit on your credit rating, bankruptcy is definitely your last alternative...0

I suggest you call a bankruptcy attorney. According to all the commercials I've seen on TV most all of them offer a free consultation and you can ask all your questions to them for FREE before you do anything. Since every state has differing laws you'd get the best information according to your state's laws; not to mention the best information with regards to your situation. Best of luck to you!0

No...not chastising...telling them to go somewhere else for advice is good advice. If you're contemplating Personal BK, a website like this isn't your best resource. I could have just as easily typed, YES, go file now, it's great way to escape your obligations. Seriously, dude do her a favor, and get her to the RIGHT resource...and don't pretend MFP is a good place to get financial advice.

Like, did you have to say "seriously?" or "Mods?" like the OP is stupid or something. If you want to suggest that the OP consult a financial advisor for the best advice, then do that. I hate to come in with background on this subject, but I worked for a few years in collections at Bank of America. My best answer would be: "Do what you think is right for you."
That said, a lot of creditors are able to work with you. I regularly set up programs that were on the verge of being outside of Bank protocol to help people make reasonable monthly payments.
That said, make sure you look into credit counselling as opposed to debt settlement firm. In short, credit counselling will negotiate with your creditors to work out monthly payments for you. Debt settlement will collect payments that are "to be allocated to your debts" each month, not make the payments, and wait about six months or so and settle with your creditors while keeping the difference between the settlement total and what you paid to them.

Not a good place to get medical, legal or marital advice, but sometimes a person might just need to open up a little communication on a subject. Sometimes they just need to hear themselves think. I don't think there should be a problem with that.

I post things in the Chit Chat forum that don't deal with weight loss all of the time. There's a reason it's called Chit-chat, fun, and games. There are other boards for weight loss advice. I thought this website was about being supportive of eachother, and I don't think it should just be about weight loss either.
OP I agree with PP that it is something you should decide if it is right for you. But you should also look at all avenues, such as debt counseling, before filing for bankruptcy. I know where you are coming from, it has taken me 5 years to pay my way out of my debt. But I think it was worth it more than filing for bankruptcy would be because it shows lenders that even though it might not have been on time, I paid my stuff off.

actually ON topic. My in-laws filed for bankruptcy and somehow managed to right away get approved to purchase a manufactured house about 80,000 loan.
It's certainly not like taking an eraser to your credit. That stuff lingers.0 -
You are all right, I was wrong not to simply chime in with my opinion on bankruptcy. It's fine to ask for opinions and advice on here...and I should have thought through it. This was placed in the right area for such topics, and I should have just given my thoughts on it, nothing more.
So, on the topic of bankruptcy, here are my thoughts. Bankruptcy should be reserved for entrpreneurs who try to add value to our GNP, and rare cases of medically induced BK, and not be relied on by people who simply live a lifestyle beyond their means (which has been estimated to be over 90% of people who file). Those that file BK because they wanted to keep up with the Jones' is the exact reason why our country is in such a financial quagmire. Filing BK is too easy in our day and age. Buy, buy, buy, then bail, bail, bail. Instead of filing, do something similar to what works in the fitness world...work harder, longer, etc until it hurts. Those that borrowed money need to have the financial responsibility to pay back their creditors, not simply to be able to escape their obligations. It was a promise to pay them back, so pay them back. Have the pride that our previous generations did, and do the right thing, not the easy thing.
You decide which camp you belong to in terms of if you have the ethical right to file, the 90% or the 10%. Myself, I've had both immense medical bills, as well as a business start-up that went bad, and a major business debt placement that went south with fraudulent startup capital on the books (i.e. ended being uncollateralized). And yes, it was a sincere ***** earning it back. But all the above were my choices, therefore my responsbility. But it was done.
So, thanks for everyone for helping me see this is a place for more than fitness, and helping people understand the merits of bankruptcy and personal responsibility as well.0
