ok here it goes....i think my weight prob is eating late in the evening....my boyfriend doesn't get home till 8:39-9 pm we eat dinner watch tv for about an hr then go to bed (this is the only meal we share together). we get up at 4am to get ready for work so its a very long day for me. typical day is 20 min break about 9am at work to eat (im a smoker so usually cram my food cuz all u get is 20 min for the 10 hr day) sneak in a snack about noon. get home about 4:30 pm I gotta eat something cuz im usually starving at this point then dinner about 9 pm

You're likely to get mixed opinions on this but from my research and own experience, a calorie is a calorie no matter when you eat it. I eat right up until I go to bed and I've lost 25 pounds and have been at my goal weight for months now. I do stay at or under my calorie limit though.

Nope, I eat late and I have snacks (look at my food diary) and I'm not gaining. Eat some light crudites if you're snacks are calorie dense to tide you over 'til dinner such as celery and carrot (raw). I deliberately fill my early evenings with activity/shopping/stuff to stop me eating 'til dinner which is late. I prefer hard exercise as it suppresses your appetite (blood going to digestive system normally goes to your muscles being worked!). Eating later will stop you snacking lots throughout the evening too as there's less evening to snack through and you will be full! There's no proof on eating late making you gain weight... data presented has been skewed and coressponded to people who ate lots and snacked lots anyway.

I've heard it doesn't matter when you eat. I also have heard that its best for weight loss to eat nothing within the last 3 hours before bed. My experience is that no matter what else I do or don't eat during the day, if I eat dinner after 7pm I will see a weight increase. I think the bottom line is making a decision based on your own body and experience.
