Found a lost fitbit

Hi all! I found a lost fitbit on the street about a week ago and I have tried SO hard to get in touch with the company. I read somewhere that someone found one and they wrote back and sent a shipping label, but I won't hear back from them.
If I don't hear back, does anyone know if I am even able to use it as my own?? If not I'm just gonna trash it, but I seriously have looked on lost and found websites and waiting to hear back from
