    Scientifically speaking, it is the ripened, seed-bearing ovary of a plant, thus (in botanical terms) it is a fruit. It also comes from a tree and can be used in fruit applications (some desserts etc), so many consider it a fruit.

    It is often considered a vegetable (in its culinary aspect) as it has many savory applications.

    So it is both a fruit and a vegetable.
