Good luck on this...mine works under the table and didn't file taxes for years to avoid paying. He also put homes, vehicles, farm equipment, bank accounts in other people’s names. After a while, I just stopped fighting. It wasn't worth it to me because even when he had to pay via court order, they still wouldn't make him. Sure they would threaten to take away his license or something but he would be warned first...all you have to do is make a payment a couple times a year and your golden in California. It wasn't a ton of money either. What is funny is that the person that helped my ex avoid his obligation is now fighting him for the same thing....you’d think she would have learned by what he did tome...karma, lol!
Mine is the same way. He even just married some chick *during his 3 yr stint in jail* , my son is 2 mind you. Pretty sure everything will go in her name (hence, why he married her) but not sure if b/c they are married if money can be taken from her (ie: taxes filed jointly or seperately)

There is a form that can be filed out with the income tax so that they don't take her part of the taxes. But if they don't fill that out and file jointly, Yes all the money will be taken. LOL.. if you're lucky they're stupid and don't do it...0 -

There is a form that can be filed out with the income tax so that they don't take her part of the taxes. But if they don't fill that out and file jointly, Yes all the money will be taken. LOL.. if you're lucky they're stupid and don't do it...
my guess is the latter. Though, i'm not sure they'll even make it to tax time. Poor girl really thought she was different. (Sarcasm overload) Here it is, not even a month and a half after his release (not even 4 months after their joyous ceremony via tv screen during a visit) and there's trouble in paradise.

There are other means by which to get payment, but you have to know people. I firmly believe that the way you deal with someone that doesn't work in the system is by utilizing alternative means (outside of the system). There are people out there that will hunt him down, and basically "make" him pay, or else he will begin to lose limbs in a very very painful way. I would not hesitate to utilize those means, if I were a woman and justice system failed me.
That stuff doesn't just happen in the movies. it's very real.
It's not mean or cruel, it's business. You want your money. He has to pay. If he works under the table, these people you have helping you will know, and they will take his money. If he runs, they will find him. There really is no way out. Well, there is one way. But, all you are doing is asking for your money. It's up to him.0 -

Here in PA, you get docked anyway. Not only do you get docked, it's horrible! They don't base your c/s on how much money you actually make, but how much you could potentially make. if you're a nurse and get a job at McD's, you still owe at the amount a nurse makes.
Send him to jail, he might change his mind. Also, if you go on welfare, in many states, they will charge HIM for it.0 -

I don't think you understand the problem. These guys work under the table for cash. They don't have bank accounts, they don't file taxes, they don't "own" a car. All accounts and cars and things are in other peoples names, and they work for cash, so they are off the radar. There is no record of them working. It's impossible to trace them down using traditional systemic methods.0 -
My sons father is recently released from 3 yrs in jail, his probation (I believe- don't know for sure b/c they won't talk to me) requires him to have an ACTUAL job ON PAPER- but I have yet to see a dime so I can't be sure. I know that the type of person he is- if he can get away with not paying and working UNDER THE TABLE he will do just that.0

I think all they can do is the general stuff like refuse his license renewal, seize his tax returns, bank accounts, etc. Because it's not a "sure thing", I don't think you could do a settlement, as the money isn't likely to ever come. And they'd likely take too much to be worth your while, similar to payday loan places.
agreed...check your state's website because you'd be surprised what you can do and you have to push your worker and give them all of the info you can for them to pursue him.0 -

I know my daughter went thru all this. Sad when courts force you to let the father see the children, but don't force the fathers to pay the child support.
If it were me, if he chose to be out of their lives (no visits) then I would stop everything right there.
But if the father is seeing the children, then I would be hauling his butt to court every chance I get. My daughter finally did get her money, but it took a very long time. Judge always threatened with next time you will go to jail. He always came up with an excuse. But he did always come to court with a check.
I have never heard of any father actually going to jail, so it is easy for the fathers to say they would rather go to jail than pay. But REALLY, would they rather go to jail. If the courts would start sending them, maybe things would change.
Because I don't know anyone that would RATHER go to jail!!!0 -

Already done... We also go back to court next week...it's futile, but I figure if I just keep on going he will eventually end up in jail. Trust me when I tell you the child support is the very least of my concerns with him....0 -

exactly. Pisses me off. He wasn't even out of jail a week and he took me to court (filed while still in jail) and he gets visits. But they ask him to pay me 60 a month and he can't do that.0 -
Depends where you are. In AB we enforce by garnisheeing bank accts and employers, federal license & motor vehicle license denials, seize assets, liens on homes or businesses, jail time, a lot more but those are the biggies.0

However, I knew a contractor where his ex did that to him. He was working under the table for cash for all his jobs. He couldnt do big jobs because he wasn't using his contractor license. But, he could do small home improvement jobs for people, and did, for cash. He was audited, but they couldn't find anything because he had nothing to show. He couldn't work everyday because they were watching him kind of. But, he'd head out for a few hours on random mornings, and go do his work, and then kick it at home for a few days. They would ask how he was paying his rent, for instance, but he'd just say that he was living with his brothers. Which he was. So, even with an audit, they couldn't get him on anything.0 -

Then you follow him too and report where he is doing these odd jobs...IRS are sharks they will do an investigation and nail his a**!! Also, he'll get married eventually and they will take her wages/taxes as well.

My ex is Canadian... when he started to fall behind in support, he moved to British Columbia. The US won't go after anyone in Canada.....
He owes $17,000 and hasn't seen his kids in three years. Yet, he calls.... and make promises and doesn't deliver. He is an *kitten*....0 -

Anyway, we verbally agreed to me giving her $400.00 per month for child support.
Once the divorce was final, the papers said to give her $335 per month.
Once I got back to the states and settled down for a few years (still paying her $400.00), I got a letter from the state of Texas with a warrent for my arrest. I called the number and it turns out that there was an arrest order because of not paying child support.
I called her and, after a five minute tirade on her, she calmly informed me that she had no idea what I was talking about.
So, after a few more calls, I was able to "go" to court VIA telephone (I live in Florida). My ex also called in.
She explained to the Judge that I have been paying her every since we were seperated.
It turns out that I was SUPPOSED to be paying the STATE and not the ex directly.
Furthermore, the state did not believe either one of us that I had been paying and garnished back wages from my paycheck. It was about $12,000 that they were yanking. Fortunatally I HAD a pretty good savings account but, instead of her doing the right thing (send the money back to me), she kept it.
Now, 15 years later, I was finally able to convince the courts that they screwed up but, there is nothing I can do. I am simply out that money.
The Father is not always the bad guy.0 -

If you kept the receipts of payment then they should have taken that. I mean yeah that's a long time to keep track of it but some of it had to have been paid by check and your bank might still have record of it? Sorry about your luck.0 -

True, if he did not sign a waiver with her stating that she can discuss with you his probation then she by law can't even acknowledge that he is even on probation. Need to protect his privacy and all that! :mad: *sarcasm* Although you can also start off the conversation as "I know that you can't talk to me, but I know that you are ... probation officer and I have information for you." and go on from there. If you have the name of the supervisor and the company then that would be even better. And make sure to end the call with "Just trying to be the productive member of society that he is not."
IF any deadbeat that doesn't pay child support gets any sort of tax return, job or inheritance then the back child support will be taken from that and given to the parent. Not that I am counting on that but just makes me wish whomever marries him isn't smart enough to file 'indigent spouse' on their tax return.:laugh:
OP just make it on your own and don't count on him doing the right thing. If you get any money then put it in a college account for your child since you don't budget with that money anyway.0 -

Incredible.... a coworker of mine has the exact same story. He paid his wife every month (even had check stubs) and once his daughter had turned 18 the state of TX came after him and claimed he NEVER paid child support. now they garnish his paycheck and take his tax refund. He tried fighting it, but with no luck, of course his ex wife isn't complaining.
as for the OP... just hang in there, it may take 18 years but eventually you will get your money.0 -
I've been going through this for nearly 9 years...... He owes about $13,000, and it would be a ton more if my husband didn't adopt my son 2 years back. He's always in jail, and when out never holds a legit job. The courts finally entered a judgement for him to pay back all the back child support (why this even had to happen considering it was done like 3 times already is beyond me) and for his wages to be garnished, but like i said, he will never hold a job.... he won't pay, they'll arrest him, but he won't do much time, and it won't do me any good.
I've been through all the avenues. They don't help. The "justice" system is a bunch of crap. I was hoping I could use one of those settlement companies... Half is better than none.
The system isn't perfect by any means but if he has no income there's no money to be given. It sucks to call it loss but really the stress isn't worth it.0 -
I know that if he ever files for Soc Security (not SSI). They will take it from him then. I know a lady that started getting back child support when her son was 35. Her ex filed for his retirement Soc Sec and they ran a check on him and found the arrearage he owed.0
