I don't think you're being rude. It can be hard to eat out when you are dieting, even if you eat something healthy but see your friends eating something you really want or like. I see at least two possible options for you:
1. Go with him and not eat. Being that he is your brother, he should understand that you are dieting and hopefully is being supportive of your goals. I hope that he would simply appreciate your company and you wanting to spend his birthday with him (and doing something he wants to) and not feel bad that you are not eating.
2. Find something on the menu that you would eat, but don't eat the whole thing. I've gone out with friends before and when there isn't a healthy option for me, I tend to just get something I like. I immediately get a to-go container and box up whatever I don't want to eat. That way I am only eating a portion of the calories. I usually end up dividing what is leftover into 1-2 meals for another day - therefore spreading the calories out over different meals.

A day on your diet should NOT be more important than your brother's birthday. It sounds like you guys are tight. In 6 months time, you won't remember going over your calories for the day, but he will remember yopu refusing to go to lunch for his birthday because of your diet.0

Go and eat a little but still eat. Its not very fun going out to lunch with someone and they just sit there and dont eat and watch you eat because they are on a diet. I would absolutely love to go out with my friend for lunch but she doesnt like to eat much.0

Eat something good and healthy before you go, then have a salad or a light side dish off the menu and eat slowly! You should definitely go, you are blessed to have a brother who wants to be able to have you join his celebration!0
