Accident at the Gym - advise please

Hi, I need some advise please.
I ruptured my ACL and have a grade 2 tear of my MCL which I did when I slipped in the shower at my local gym. I did this 8 weeks ago now. I have had physio and no longer have to wear a knee brace for every day stuff, but it still feels wobbly and I can’t go down stairs properly yet. I have been advised to use it for doing exercise only, not that I have done that much lately, just general getting around and walking the dog. I miss going to the gym as I had been a member for 6 months and managed to lose 2 stone and was getting to a good level of fitness.
I was advised to sue the gym as they had no mats in the showers until a week after my accident. They now all have mats in them. I really want to go back to the gym and do light exercise, but do you think they might get funny about it as I am suing them? I still pay my membership monthly.
My questions are –
Has anyone had an accident at the gym they belong too? Or sued them. What was the outcome?
Also, I might need surgery on my knee, has anyone had it and would you advise to go for it.
Any advise would be grateful
Thanks Clare

Did you report the accident to them? IF not, try doing that first and seeing if they'll submit a claim to their insurance....0

Check your membership paperwork. They may have a clause that prevents you from suing if injured on the premises. Most gyms have them...0

If you are suing them, this question should be posed to your attorney.0

Since you are suing, you have a lawyer. All questions should go there first. And, good luck to you, hope you can get exercising again soon.0

yep, I did report it, the PT add it to the accident book and told me to get to A&E as I couldn't walk. Funny thing was he went looking for an ice pack and couldn't find one. Lucky my OH was with me and could drive me to the hospital.0

Your gym should have accident insurance. See if they're willing to help you first. If not take all your paper work to a lawyer to see if your case has merit. If it does, then you can make the decision. Though if you sue them, you should probably find a new gym.0

I've had an accident before, I tripped on the treadmill and you can still see the scrapes on my legs now, three years later. But it never occurred to me to sue them... I always considered it to be my own clumsiness. Okay, they could have better informed people about those safety lines on the treadmills that are always there but no one ever uses or even seems to know about.
If you really are going to sue them it would be most unprofessional for any of the staff to treat you differently, after all, it's nothing personal. But they might since they're only human... Me, I'd just feel really uncomfortable still going to that gym that I'm suing. I'm too sensitive to what they might be saying behind my back.0 -
I was playing badminton on June the 8th, twisted wrong and tore my ACL, MCL and Meniscus. I am doing PT at the moment in hopes of avoiding surgery. I can tell you the MCL will heal over time, this is the second time I've torn mine. The ACL depends on the tear and what is happening inside. I just got back to the gym 2 weeks ago and at half of what I was doing before. My specialist is going with a conservative approach by doing rehab first, but I may still require surgery. I go tomorrow to rehab and see how my range of motion is, if it's not better than the last time then I may have to move surgery up.
My therapist said I can do elliptical and bike only. I don't have enough dynamic range and stability to do the treadmill and absolutely no weight training until I have full mobility. Talk to your therapist, do the stretches and exercises. As far as suing, that's a personal decision. I think if you are going to do it, talk to a lawyer about going back there.0
