I can tell you from personal experience that reporting pics to Facebook, even if it has your face in them, will not do any good. I can report defaced nasty pics of me all day long and Facebook says it's not against their community standards. I actually have a police report filed for harassment against the offending poster and will have to go to civil court to get Facebook to take the pics down. Security on Facebook is a joke, as well. You can't even delete a Facebook accout. The only thing you can do is deactivate it and thenall it takes to reactivate it is to simply sign back in.

Way to mix up different issues.

If you say the right things the right way, Facebook will take it down. That's why you have to claim copyright infringement.

No..they won't take it down. No matter how I word it.

Lol. Yes they will. I win!

Seriously. You probably don't know how to approach it. I'm telling you, I was a professional photographer. We have to deal with this crap all the time. It's half your job these days is tracking down thieves and then getting the content removed.

They were told that these are pics of me that the offending poster did not take and did not have authorization to use. They set up community pages specifically to bully my family and it even says so in the pages' descriptions. I claimed copyright infringement and harassment. So please.. what did I miss?

Edited to add: These were not pics that had ever been previously published on Facebook before either.

Seems like normal internet "List Article" rubbish. On what grounds would you report it, exactly, and why would it be your right to curtail his/her free speech on this matter?

I guess fundamentally if you don't want your pics re-used by random strangers in unpredictable ways, don't share them on the internet.

The people who took the photos are the legal copyright owners of the photos, and people using them without permission is breaking copyright law. Additionally there are privacy laws about using pictures of people without their permission, which are separate to copyright laws. Even if you own the copyright of a picture of someone else you can't just use that picture for any purpose.

I agree with the general advice about being really careful who you share your pictures with online though. This kind of thing is pretty common, and frequently they can't track down the person doing it to take any action against them. Although if you know who's hosting the website, you can contact them to let them know that the person is using copyrighted images without permission and the web hosts may remove that person's account, although that doesn't stop them from setting up the same site with a different web host.

Wordpress (blogging web hosts) have some really good advice about how to deal with intellectual property theft in their help section, although maybe you need to have a wordpress blog before you can read that advice (worth a try seeing if you can access it without a wordpress account though, because you probably can)

Not a lawyer, but I play one on TV  (JK). But you have to be careful of this as when you sign up on these sites, part of their licensing agreement most likely is the wavering of your own rights. I've seen this come up before like with Netflix. There is a federal public right to use law that allows public viewing for say education, but this right it waived in Netflix's licensing agreement and thus trumps the federal law by the customer. So while I could publicly show a movie on DVD to a classroom, I could not show that same movie being distributed through Netflix as I would be in license violation. The same might apply here, just saying.

I have a different take on this...

So, 100,000+ anonymous people can now see anonymous before/after pics of an individual how has taken charge of their life and achieved the admirable goal of weight loss and fitness.

If one of those pics were of me, I don't think I would give a rat's *kitten*... I really don't care what others think of me or my weight, especially people I don't even know and will probably never meet. In my opinion, this is no different from me walking through Walmart and someone snickering behind my back saying "I bet that chick eats too much Nutella." Yeah, it kinda sucks and is rude and probably offensive, but I don't let others control how I feel about myself.

But from a legal/copyright law perspective, if you feel your rights have been violated, then by all means, take action.

Don't use the word 'retarded' to describe something bad. It's offensive.

^^^^ agreed, i find this more offensive too.

As people have said previously if you put your pic online expect it to become public property .. i wouldnt mind if they took mine and posted it on something like that if it taught people to look after their bodies better and not take it for granted .

I'm just not quite sure what to say.....

Hire an attorney. Sometimes, you gotta pull in the big guns. Facebook is a multi-billion dollar corporation. They don't always respond to the little guy. Sometimes you have to put weight behind the threat. Lawyers know how to break through the corporate barrier and get a response. The last thing a web host company wants is a lawsuit over something like this, a decision by a judge not in favor could have huge broad sweeping impacts across their entire company about how theses things are dealt with. They'll settle immediately with a letter. If they don't, follow through. Never carry empty threats. Always follow through.

That's exactly what I'm doing.. getting an attorney and filing a civil suit for breach of contract. According to their own community standards, they have to take it down if it's a pic of me that I didn't authorize. Thank you for the advice. :)

Thank you. I find the derogatory use of the word "retarded" even more offensive than fat shaming--it's shaming of the mentally impaired who are often the sweetest people you could have the privilege of knowing.

    Amen.

If it's not a picture of you or your family or friends, I'd befriend and/or block him. Why are you friends with someone like that?
