Not gonna even get into whether I think it's OK, just gonna ask 2 questions:
1) Are you prepared to deal with your brother and the rest of your family?
2) Are you aware that she might be his ex for a reason that's not readily apparent to you? And that you putting any blame on your brother for the failure of the marriage might be tainted by just getting her point of view?

If you and your brother are on good terms you should ask him first.
If you are on bad terms or don't speak, screw it go for it if you want to.
Most people would feel weird to get with someone even their friend had called dibs on let alone brother, I mean they slept together, but if you think it through and it doesn't bother you, whatever why not.0 -

Some cultures would consider it providing a home and a father for the boy especially if it's OK with the in-laws! Uncle-daddy is the stigma name given by the "judges". I think the boy will have a less of a problem than the "judges" do! Is it better for him to have a complete stranger, with no blood ties, as a step-father? Sometimes, in joint families kids call the eldest uncle big daddy or some patriarchal name anyway. Much ado about nothing, if you really look at it from the benefit point of view, keeping the "family" , albeit bloodline together (if you can think beyond individuality that is). Bottom line is, the guy needs to figure out whether it is just a fling or "weather it together".0
